Terms

Last updated 24 October 2026. “I” and “me” mean Swirly, a sole trader run by [your full name], based in the UK.

Part 1: Working with me

1. Booking

A project starts when you accept my quote in writing (message or email). Prices are quoted and paid in US dollars (USD).

2. Payment

For single thumbnails, payment is due on delivery. For monthly retainers, payment is due monthly. I release the final files once payment has been received.

3. What’s included

The price covers the thumbnail(s) described in the quote and two rounds of revisions, including for retainer work. Extra rounds, or changes to the brief after approval, may cost more and I’ll tell you before I start.

4. Your materials

You must have the right to use any text, images, logos or footage you send me. You’re responsible for any claim that your materials infringe someone else’s rights.

5. Timeframes

Delivery dates are estimates. They depend on getting your materials and feedback promptly.

6. Ownership and usage

Once I’ve been paid in full, you may use the final thumbnail for your videos and channel without time limit. I keep ownership of my working files and layers, and any stock or third-party elements stay under their own licences.

7. Portfolio

I may show finished work in my portfolio and on social media unless you ask me not to in writing before the work begins.

8. Cancellations and refunds

You can cancel before I’ve started at no charge. If you cancel after I’ve started, I may charge for the work already done. Retainers run month to month, so please give me [7 days’] written notice before the next monthly payment is due. If I can’t deliver what we agreed, I’ll refund what you’ve paid for it.

9. No guarantee of results

I design thumbnails to help your videos stand out, but I can’t promise any number of views, click-through rate or channel growth. These depend on many things outside my control.

10. Liability

I will do the work with reasonable care and skill. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn’t allow me to limit. Otherwise my total liability is limited to the amount you paid for the project, and I’m not liable for indirect losses such as lost income.

11. Your legal rights

If you’re an individual buying for personal rather than business use, you have legal rights as a consumer that these terms do not take away.

12. Disagreements and law

Please contact me first so we can fix things. These terms are governed by the law of [England and Wales] and its courts.

Part 2: Using this website

The designs, text and layout on this site belong to me or the creators who commissioned them. Please don’t copy or reuse them without permission. The site is provided “as is”, and I’m not responsible for other websites that I link to.

Changes

I may update these terms. The version in place when you accept my quote applies to that project.
